I refer to your Freedom of Information request in relation to Depot
Audits.

Right of Access

Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled.

(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and

(b) if that is the case, to have that information communicated to him.

The right is to obtain access to the information itself and not to the
document or record which contains it.

The Act creates a general right of access to information held by public
authorities subject to various exemptions.

Please can you provide me with a copy of all Depot Audits (including
Compliance audit reports and Health & Safety audit reports) that were
carried out during the past 5 years.

Duty to confirm or deny

The public interest test requires Northumberland County Council to confirm
that we hold certain information relating to Depot Audits.

Exemptions

The Freedom of Information Act sets out various exemptions to the right of
access.

In the present case the County Council takes the view that the information
relating to your request is exempt under the following provisions.

• Section 12(1) Exemption where cost of compliance exceeds appropriate
limit

Section 1(1) does not oblige a public authority to comply with a request
for information if the authority estimates that the cost of complying with
the request would exceed the appropriate limit.

The time and cost involved in extracting the requested information would
exceed our statutory obligation to comply with the request; e.g. 2.5 days
and/or £450. It will take us approximately 1 hour per report to pull
together the information and apply the relevant exemptions prior to
releasing the reports. As it stands your request is for 144 reports, which
tallies up to approximately 144 hours to provide a full response.

Notice of Refusal

Please treat this letter as a Notice of Refusal as regards the information
covered by the Section 12(1) Exemption.

Advice and Assistance

The County Council recognises its statutory duty to provide advice and
assistance under Section 16 of the Act. Subject to the provisions of the
Freedom of Information Act, the Council is seeking to be transparent and
open in its response.

 

If you would like to reduce the scope of your request to 1 year worth of
Depot Inspection and Health and Safety Reports, we would be able to

Duty to confirm or deny

Northumberland County Council confirms it holds the information you have
requested. Please note the attachments will be sent to you in another
email as the attachments are too large to send to you this way. 

Exemptions

The Freedom of Information Act sets out various exemptions to the right of
access.

 

The redactions of the attached Depot Inspection and Health and Safety
Reports have been applied under:

 

FOIA Section 40(2) Personal information of a Third Party – which we have
followed to remove third party personal data from the Depot Inspection
Report.

 

FOIA Section 31(1)(a) Prevention and Detection of Crime – which we have
followed to remove information that could impact on the prevention and
detection of crime.

 

Public Interest Test and Considerations   

 

Section 31 (1)(a) is a qualified exemption which means that the
information falling within the exemption still has to be released unless
the public interest in disclosure is outweighed by the public interest in
maintaining the exemption. 

    

The reasons why the public interest favors providing the information  

   

·         Withholding the information could be perceived as the Council
having something to hide from the public.     

·         It is in the public interest to be open and transparent about
depot inspections and, health and safety compliance.     

·         It is also in the public interest to provide transparency
regarding the records we hold in respect of the depot inspections. 

   

The reason why the public interest favors withholding the information 

     

·         The release of this information will be prejudicing the ability
the Council has in ensuring we are able to deter crime, which would not be
in the public interest.    

·         There is a public interest in protecting the commercial
interests of the Council ensuring crime prevention where possible is
applied. 

·         Disclosure of the requested information could prejudice the
Council’s future negotiation capabilities and reduce confidence third
parties have with the Council

  
Conclusion 

 

The public interest in withholding the requested information outweighs the
public interest in disclosure of the requested information and in
particular we consider that the public interest in maintaining the Section
31(1)(a) exemption for redactions outweighs the public interest in
disclosing the information in full.
