In a judgment handed down this morning, Mrs Justice Cockerill has given important guidance on the effect and scope of a submission to the jurisdiction by a defendant in proceedings. The Court determined that, provided that the defendant is a “willing participant”, there is no relevant distinction to be drawn between a defendant and a claimant for the purposes of submission. In such a case the defendant renders itself amenable to such claims as the Court considers ought to be heard against it simultaneously with the existing claims. The symposium brings together legal experts from various international law schools and universities, and members of the judiciary to participate and debate new, qualitative, and distinguished research papers.     The Court of Appeal (the Master of the Rolls, Lord Justice Lewison and Lady Justice Falk) has provided guidance on the use of a single claim form by a group of claimants in the matter of 𝑴𝒐𝒓𝒓𝒊𝒔 𝒂𝒏𝒅 𝒐𝒕𝒉𝒆𝒓𝒔 𝒗 𝑾𝒊𝒍𝒍𝒊𝒂𝒎𝒔 & 𝑪𝒐 𝑺𝒐𝒍𝒊𝒄𝒊𝒕𝒐𝒓𝒔 (𝒂 𝒇𝒊𝒓𝒎) [𝟐𝟎𝟐𝟒] 𝐄𝐖𝐂𝐀 𝐂𝐢𝐯 𝟑𝟕𝟔. The case involved 134 individuals and companies claiming damages for professional negligence against their former solicitors. They together issued a single claim form. The defendants sought to strike out the claim arguing that on proper construction of the Civil Procedure Rules 1998 ("CPR"), it was only permissible for one claimant, or joint claimants pursuing the same cause of action, to use one claim form. The Court of Appeal rejected that argument as had His Honour Judge Jarman KC (sitting as High Court Judge) at first instance.
